The partnership represented Shell Bulgaria in seeking and obtaining a merger clearance for the acquisition of 4 petrol stations from Litex Commerce. These petrol stations in question were part of Shell’s chain of petrol stations in Bulgaria for more than 22 years, operated under long-term usage right and the notified transaction was about Shell paying a price for the full title over them. CPC took the view that the change of the legal grounds for exercising control, does not qualify as concentration with the meaning of article 22 of the Competition Protection Act.
