LITIGATION, ENFORCEMENT AND INSOLVENCY

Assisting our clients in dispute avoidance or resolution, in the most efficient manner, is a consistent part of our Litigation, Arbitration and Dispute Resolution practice. Our team provides assistance in pre-trail negotiations and full legal representation in all Bulgarian courts, domestic and international arbitration tribunals in various civil, labour, consumer, commercial, administrative, tax and regulatory matters, bankruptcy, insolvency and private enforcement. Since most of our clients are multinational corporations, we have notable expertise and experience in handling cases related to settlement of cross – border disputes, and recognition and enforcement of foreign arbitral awards and court judgments.

Selected mandates below:

  • Defending Bulgarian Energy Holding EAD (Bulgaria’s largest company by assets and national champion in the energy sector) in litigation under the Public Information Access Act and as an employer in two employee litigation cases.

  • Successfully defending the Ministry of Transport, Information Technology and Communications in an arbitration case before the Court of Arbitration with the ICC in Paris.

  • Successfully representing CEZ Electro AD in an arbitration case at the Arbitration Court of the Bulgarian Chamber of Commerce and Industry in a BGN 10+ million claim, filed by the National Electric Company EAD.

  • Representing Health and Wellness AD in a claim by the insolvency trustee of Corporate Commercial Bank AD, under the Bank Insolvency Act.

  • Representing the Bulgarian subsidiary of a private equity fund in the largest possible voluntary insolvency (in excess of BGN 3 billion).

  • Advising the syndicate of Kremikovtzi AD in the process of collecting, reviewing and challenging creditors’ claims, attendance at court-arranged meetings and negotiations with creditors.

  • Аcting for Barclays Bank plc in relation to a consensual restructuring of an approximately EUR 700 million secured loan and associated debts owed by the Quinn Group and, among others, its Bulgarian subsidiaries to various lenders including Barclays Bank.

  • Аcting for BNP Paribas in relation to a consensual restructuring of an approximately EUR 1.5 billion secured loan and associated debts owed by the Monier Group and, among others, its Bulgarian subsidiary to various classes of bank and bond creditors.
