Our competition team, involving Georgi Spasov and Kremena Yaneva-Ivanova, has successfully assisted Energo-Pro Sales, the public electricity supplier in the North-East Bulgaria, in its court appeal against a decision of the Competition Protection Commission by which the company was fined some BGN 1.6 million for abuse of dominance. Following three-year and a half court proceedings, the Supreme Administrative Court finally held that our client did not act in breach of Art.21 of the Competition Protection Act by suspending the supplies of electricity to a business customer – the public water and sewage supplier in Dobrich, due to unpaid invoices for the price of the consumed electricity, and therefore, annulled the infringement decision together with the fine imposed thereby. Energo-Pro Sales was advised and represented on this matter in all stages, including during the administrative procedure at the competition regulator and at court, by both lawyers stated above.
